1. Who these terms are with
These Terms & Conditions ("Terms") govern your use of outinfront.ie and its product page The Beacon (together, "the Site"), and any product or service purchased through them, including The Beacon, The Beacon Pro, Beacon Intelligence, and the Out In Front multi-location visibility system. By using the Site, submitting an enquiry, or purchasing a product or service from us, you agree to these Terms. If you do not agree to them, please do not use the Site or purchase our products.

Enquiries submitted through this Site (via "Get Your Beacon" or "Book a Demonstration") do not themselves create a contract — a contract is only formed once we confirm your order or engagement in writing (e.g. by email or a signed agreement) and, where applicable, payment is received.
3. Eligibility
Our products and services are intended for businesses and organisations, not consumers acting purely in a personal capacity. By submitting a form or placing an order, you confirm that you are at least 18 years old and have the authority to act on behalf of the business or organisation named in your enquiry.
4. Pricing and payment
- The Beacon, Beacon Pro and Beacon Intelligence are offered as one-time purchase prices as displayed on the Site at the time of your order; prices are shown in Euro and may or may not include VAT — this will be clarified at checkout/invoicing. [Confirm whether prices are VAT-inclusive.]
- We reserve the right to change our prices at any time, but changes will not affect an order you've already had confirmed in writing.
- Out In Front pricing and scope is agreed individually with each organisation and set out in a separate proposal/agreement, not on this Site.

5. Delivery, setup and what's included
Physical Beacon kits and starter packs are prepared and delivered/installed as described on the relevant product page at the time of your order. Digital features (publishing account, templates, analytics, reporting) are made available once your account is set up. Estimated delivery, setup and onboarding timelines will be confirmed with you directly and may vary depending on your location and requirements.
6. Cancellations, changes and refunds
Because each package includes a physical, branded Beacon kit produced for your business, please note:
- You may cancel an order before it has been confirmed and/or before any physical materials have been produced, without charge.
- Once a branded Beacon kit has been produced or dispatched, it is a personalised item and we may not be able to offer a refund for that physical component, except where required by law or where the product is faulty. [Confirm your actual refund window/policy here.]
- Digital-only elements of a package (publishing account, reporting) may be cancelled going forward at any time by contacting us, without affecting fees already paid for the physical kit or elapsed service period.
- Nothing in this section affects any statutory rights you may have as a consumer or business under applicable law.
7. Your responsibilities
When using The Beacon, Beacon Pro, Beacon Intelligence or Out In Front, you agree to:
- Only publish content (offers, events, messages) that you have the right to publish and that is lawful, accurate and not misleading.
- Not use the Site, your Beacon, or your publishing account to distribute unlawful, defamatory, obscene or infringing content.
- Keep any login credentials for your publishing account confidential and notify us promptly of any unauthorised use.
- Ensure the physical Beacon is displayed and maintained in line with the guidance we provide (e.g. the Beacon Playbook).
We reserve the right to suspend or remove access to the publishing platform if we reasonably believe these responsibilities have been breached.
8. Intellectual property
The Site, its design, the OutInFront and Beacon branding, logos, software and underlying technology remain our property (or that of our licensors). Content you publish through your Beacon account (your own offers, events, messages, business branding) remains yours; by publishing it through our platform you grant us a licence to display and transmit it solely for the purpose of operating the Beacon/Out In Front service for you.
9. Analytics and reporting (Beacon Intelligence)
Scan, engagement and performance analytics provided as part of Beacon Intelligence (or basic reporting included in other tiers) are provided for your own business insight. They are based on aggregate, non-identifying scan/engagement data relating to your own Beacon(s) and are provided "as is" — we do not guarantee any particular business outcome, footfall increase, or sales result from using this data or any Beacon product.
10. Service availability
We aim to keep the publishing platform, microsites and reporting dashboards available and functioning, but we do not guarantee uninterrupted or error-free operation, and we are not liable for downtime caused by factors outside our reasonable control (including third-party hosting infrastructure, internet connectivity issues, or scheduled maintenance).
11. Limitation of liability
To the maximum extent permitted by law:
- We provide the Site, products and services with reasonable skill and care, but do not warrant that they will be uninterrupted, error-free, or achieve any particular business result.
- We are not liable for any indirect or consequential loss (such as loss of profits, business or goodwill) arising from your use of the Site, a Beacon product, or Out In Front.
- Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

12. Termination
You may stop using your Beacon publishing account at any time. Where reasonably possible, we will give you notice before doing so.
13. Changes to these Terms
We may update these Terms from time to time to reflect changes to our products, services, or legal requirements. The "Last updated" date at the top of this page shows when it was last revised. Continued use of the Site or our services after an update constitutes acceptance of the revised Terms.
14. Governing law
These Terms are governed by the laws of Ireland, and any disputes arising from them will be subject to the exclusive jurisdiction of the Irish courts, unless otherwise required by applicable consumer-protection law in your own jurisdiction.
